This Privacy Policy explains how we collect, use, share, and sell your personal information when you visit our website or submit a quote request form.

  • Truck type and fleet size

When you visit our website, we may automatically collect:

  • Communicate with you. We or our partners may contact you by phone (including automated calls and prerecorded messages), text message, or email about insurance products.
  • Improve our service. We use analytics data to understand how visitors use our site, optimize the user experience, and improve our matching process.
  • Comply with legal obligations. We retain consent documentation for compliance with the Telephone Consumer Protection Act (TCPA) and other applicable laws.

3. How We Share and Sell Your Information

This is important: when you submit your information through our website, your personal data will be shared with and sold to third parties. Specifically:

  • Licensed insurance agents and brokers who specialize in commercial trucking insurance will receive your information and may contact you.
  • Insurance aggregator platforms and lead buyers (such as SmartFinancial, Tivly, and similar services) purchase leads from us and may further distribute your information to their own network of insurance professionals.
  • Insurance companies may receive your information through agents or aggregators in our network.
  • Your information may be sold to more than one buyer and you may be contacted by multiple insurance agents, companies, and aggregators.
  • Lead re-sale. Companies that purchase your lead from us may resell or redistribute it to additional insurance professionals.

We may also share your information with service providers who help us operate our website (hosting, analytics, consent verification), and when required by law, court order, or government request.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies on our website:

  • Necessary cookies: Required for the website to function (form submission, session management). These cannot be disabled.

  • TCPA consent documentation (consent records, timestamps, IP addresses, disclosure text): 7 years, to support compliance and litigation defense beyond the 4-year TCPA statute of limitations
  • Lead matching data (truck type, cargo, fleet size, ZIP): 3 years
  • Website analytics data: 14 months (Google Analytics default setting)
  • Cookie consent preferences: 12 months, then you will be asked again

If you submit a deletion request, your data is deleted within 45 days, except for TCPA consent records which must be retained for legal compliance. Opt-out requests are processed within 10 business days.

6. Your Privacy Rights

For All Users

Regardless of where you live, you can:

  • Request a copy of the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your personal information (subject to legal retention requirements)
  • Opt out of future communications by texting STOP to any text message, clicking unsubscribe in any email, or contacting us at [email protected]

We process all requests within 10 business days for opt-outs and 45 days for data access, correction, or deletion requests.

California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: You can request the categories and specific pieces of personal information we have collected, used, disclosed, and sold about you.
  • Right to Delete: You can request deletion of your personal information, with limited exceptions (such as legal compliance).

InsuredTruck.com operates as a lead generation service, not as an insurance company. Your information is not subject to the California Insurance Code exemptions because it is not collected for insurance underwriting purposes. We comply fully with the CCPA and CPRA.

Texas Residents (TDPSA)

If you are a Texas resident, you have the following rights under the Texas Data Privacy and Security Act (TDPSA):

  • Confirm whether we are processing your personal data
  • Access your personal data in a portable format
  • Correct inaccuracies in your personal data
  • Delete your personal data (with limited exceptions)
  • Opt out of targeted advertising, sale of your data, or profiling

7. Do Not Sell or Share My Personal Information

Under the CCPA and similar state privacy laws, you have the right to opt out of the sale or sharing of your personal information. We sell lead data to insurance agents and aggregator platforms as described in Section 3.

To opt out:

  • Submit a written request to our mailing address (see Section 12)

We will process your opt-out request within 10 business days. Once processed, we will stop selling your personal information to new buyers. We cannot recall information already shared with third parties prior to your request, but we will notify our current lead buyers of your opt-out.

If you opt out, you can still use our website and submit quote requests, but your leads will not be distributed to our network of agents and aggregators.

8. TCPA Consent and Documentation

When you submit a quote request form on our website, you provide express written consent under the Telephone Consumer Protection Act (TCPA) to be contacted by licensed insurance agents and their partners. We document this consent with:

  • The exact disclosure language you were shown at the time of submission
  • The date, time, and timezone of your submission
  • Your IP address and browser/device information
  • The URL of the page where you submitted the form
  • Which consent checkboxes you selected
  • A unique form submission identifier

We may use third-party verification services (such as ActiveProspect TrustedForm or Jornaya LeadID) to create independent, tamper-proof records of your consent. This documentation is retained for at least 7 years.

To revoke your consent:

  • Text STOP to any text message you receive
  • Tell any calling agent to add you to the do-not-call list
  • Click unsubscribe in any email
  • Email [email protected]

We will honor revocation requests within 10 business days. Revocation stops future contact from us and our partners but does not erase your consent documentation, which is retained for compliance purposes.

10. Children's Privacy
